Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer can make use of his right of withdrawal;
Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with Bison Club B.V.;
Duration transaction: a distance contract concerning a series of products and services, or just services, of which the delivery and/or purchase obligation is spread over time;
Durable data carrier: any means that enables the consumer or Bison Club B.V. to store information addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored data.
Right of withdrawal: the possibility for the consumer to renounce the distance contract within the cooling-off period;
Distance contract: an agreement whereby, in the context of a system organized by Bison Club B.V. for distance selling of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication;
Technique for distance communication: This can be used to conclude an agreement without the consumer and Bison Club B.V. coming together simultaneously in the same room.
Article 2 – Applicability
These general terms and conditions apply to every offer of Bison Club B.V., and every distance contract and order concluded between Bison Club B.V. and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, before the distance contract is concluded, it will be indicated that Bison Club B.V. can view the general terms and conditions and will be sent free of charge at the consumer's request as soon as possible.
If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can be stored simply on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be consulted electronically and that they will be sent free of charge at the consumer's request electronically or otherwise.
Suppose specific product or service conditions apply in addition to these general terms and conditions. In that case, the second and third paragraphs apply mutatis mutandis, and the consumer can always invoke the applicable provision that is most favorable to him in the event of conflicting general terms and conditions.
If at any time one or more provisions in these general terms and conditions are wholly or partially void or destroyed, then the agreement and these terms and conditions will remain in force for the rest, and a provision in mutual consultation will replace the relevant provision without delay of the original as closely as possible.
Situations not regulated in these general terms and conditions must be assessed 'in the spirit' of these general terms and conditions. Uncertainties about the interpretation or content of one or more provisions of our terms and conditions must be explained 'in the spirit' of these terms and conditions.
Article 3 – The Offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The offer is without obligation. Bison Club B.V. is entitled to change and adjust the offer. Obvious mistakes or errors in the offer are not binding on Bison Club B.V.
All images and specifications data in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.
Images accompanying products are an accurate representation of the products offered. Bison Club B.V. cannot guarantee that the displayed colors correspond precisely to the exact colors of the products.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer. This concerns, in particular: the price, including taxes; any shipping costs; how the agreement will be concluded and which actions are required for this; whether or not the right of withdrawal applies; the method of payment, delivery, and execution of the agreement; the term for acceptance of the offer, or the term within which Bison Club B.V. guarantees the price; the amount of the rate for distance communication if the costs of using the technology for distance communication are calculated on a basis other than the regular base rate for the means of communication used; whether the agreement will be archived after its conclusion, and if so, how it can be consulted by the consumer; how the consumer, before agreeing, can check and, if desired, restore the data provided by him in the context of the agreement; any other languages in which, in addition to Dutch, the agreement can be concluded; the codes of conduct to which Bison Club B.V. is subject and how the consumer can consult these codes of conduct electronically; and the minimum duration of the distance contract in the case of a long-term transaction. Optional: available sizes, colors, and types of materials.
Article 4 – The Agreement
Subject to paragraph 4, the agreement is concluded at the time of acceptance by the consumer of the offer.
Article 5 – Pre-order
When placing a pre-order for Bison Club B.V. products, you must provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. Bison Club B.V. shall have no responsibility or liability for inaccurate information or information that later becomes outdated and shall have no obligation to make efforts to determine the correct contact or shipping information.
You will be charged the total price of the products at the time of placing the pre-order. If Bison Club B.V. cannot start shipping the products on or before six months after you place the pre-order, Bison Club B.V. shall process a full refund to you. Your placing of a pre-order constitutes your express agreement to Bison Club B.V. to charge the full price of the products at the time of your order being placed to the account provided.
All pre-ordered products are not yet in production and are therefore subject to change. Quantities, ingredients and packaging might differ from stated on the website as per 26/10/2022.
Article 6 - Limitation of liability
Under no circumstances will Bison Club B.V. be held liable for any incidental, special, or consequential damages arising or related to this agreement. In the event, Bison Club B.V. is held liable for any damages arising out of or related to this agreement, your sole and exclusive remedy will be the full refund of your purchase price, but in no event shall Bison Blub B.V. be responsible for any applicable interest, taxes, or shipping costs.
Article 7 - Changes to the Terms
Bison Club B.V. reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes, and if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your order.
Article 8 – Disputes
Dutch law applies to these Terms. Subject to mandatory legal provisions providing otherwise, any conflicts that may ensue from these Terms will be submitted to the Dutch Courts' jurisdiction in the Amsterdam district.
